Photography Terms of Service
1. Introduction
These terms and conditions govern the contractual agreement between aviastud.io, hereinafter referred to as the "Photographer," and the client, hereinafter referred to as the "Client," regarding the provision of photography services as outlined in this agreement.
2. Services
The Photographer agrees to provide the following services to the Client:
- Photography coverage for the specified event(s) or session(s) as outlined in the agreement.
- Editing and retouching of selected images to meet professional standards.
- Delivery of high-resolution digital images to the Client via personalized Pixieset Client Gallery.
3. Payment
The Client agrees to pay the Photographer the total agreed-upon fee for the services rendered. Payment terms, including deposit requirements, installment payments, and final payment due dates, will be outlined in the agreement.
4. Cancellation and Rescheduling
In the event that the Client needs to cancel or reschedule the photography session or event, they must provide 14 days' notice to the Photographer. The initial deposits or payments made by the Client are non-refundable but may be applied toward a rescheduled session within 6 months.
5. Copyright and Usage
The Photographer retains all copyright and ownership rights to the images captured during the session or event. The Client is granted a non-exclusive, non-transferable license to use the images for personal use only, including printing, sharing on social media, and displaying on personal websites. Commercial use of the images is strictly prohibited without the Photographer's prior written consent.
6. Photo Credit
In accordance with the terms of this agreement, the Client agrees to ensure that appropriate photographer credit is provided on all images shared via online platforms, where applicable. This acknowledgment serves to recognize the photographer's work and facilitates the discovery of their talent by others.
7. Model Release
The Client grants the Photographer permission to use the images for promotional purposes, including but not limited to advertising, marketing materials, and online portfolios. The Client agrees to waive any claims to royalties or compensation arising from the use of their likeness in the images.
8. Client Responsibilities
As our valued client, we ask that you communicate openly with us regarding your preferences, expectations, and any special requests you may have. Please arrive on time for your session and come prepared with any props or wardrobe items you wish to include.
9. Liability
The Photographer will make every effort to deliver high-quality images to the Client but cannot be held liable for unforeseen circumstances that may affect the outcome of the photography session or event, including but not limited to equipment failure, inadequate lighting, inclement weather, or acts of nature.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of Oakland County, MI. Any disputes arising from this agreement shall be resolved through arbitration in Oakland County, MI.
11. Entire Agreement
This agreement constitutes the entire understanding between the Photographer and the Client and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
12. Acceptance of Terms
By booking a photography session or event with the Photographer, the Client acknowledges that they have read, understood, and agreed to abide by the terms and conditions outlined in this agreement.
